1.We represented a number of severely brain-injured children who were sexually molested while patients in a convalescent hospital. Those cases settled early this year for confidential amounts.
2.We reached an $850,000 settlement in May on behalf of a husband and wife who were struck by a train while driving across a railroad crossing in their dumptruck. The case took almost four years to resolve. Claims were brought not only by our clients, but also by numerous passengers on the train. This railroad crossing had a long history of accidents.
3.We settled for $1,000,000 a wrongful death case involving an industrial wheel turning machine.
4.We settled for $800,000 a case on behalf of a woman who was struck by a van that drove into the front of a chain discount store. Virtually our entire office staff was involved in a massive effort to inspect various stores owned by this chain around the State of California. As a result of those efforts, we were able to show that the store had a practice of protecting the fronts of their stores with concrete pillars (called bollards), but failed to provide such protection at the store where our client’s accident occurred.
5.We have been heavily involved in pharmaceutical litigation. We are representing several clients who contracted a horrific disease called nephrogenic systemic fibrosis as a result of receiving injections of dye in connection with MRI procedures. One of our cases settled in July, and two others continue.
6.We are also reviewing numerous potential cases involving the over-the-counter medication Zicam Nasal Gel, which has been proven to cause some users to lose their sense of smell. We previously handled a case, several years ago, involving a similar product. Then, in June of 2009, the FDA issued a warning about the dangers associated with Zicam Nasal Gel. Shortly thereafter, the manufacturer took the product off the market. Litigation is now underway in Arizona involving hundreds of plaintiffs.
